Minutes: The November 2008 Commissioners Meeting Minutes were approved.

Financial:  The November financial report was reviewed.

Academy Update:

  • 2 rentals on the books for 2009
  • Interior painting was completed and on budget at $7716.
  • Propane:  Suburban will be picking up their propane tank and Amerigas has been contracted to install their tank and supply the Academy with propane.  Amerigas charges less per gallon; swap out of above ground propane tanks will cost $150.  The cost of buying and installing an underground propane tank is costly.

Brookeville Schoolhouse:  A pest control company will come out Dec 9th to inspect the Schoolhouse for general pest control

Speaker:  Mike Whitcomb, Energy Manager for Montgomery College, has been engaged for a presentation on Solar Energy Feb. 2, 2008 at 7:30pm at the Brookeville Academy.  All town residents will be invited.

Verizon:  Water St. was missed when Verizon FIOS was installed in the Town.  Clerk will contact Montgomery County liaison about installing FIOS along Water St.

309 & 311 Market:  owner of properties appeared before the court on Nov 25th.   Owner was given 90 days to get properties up to code.  Next court date on this matter is scheduled for March 2, 2009.

Holiday Party Evaluation:  All agreed that the Holiday Party Dec 6th was a success.  There was a request for residents to wear name tags next year.

Snow Removal:  Todd Greenstone was contracted to provide snow removal along North, South, Church and Water Streets at a slight increase over last years rates.

Gravel Road Maintenance:  Neal Leary was contracted for maintenance of the Town’s gravel roads.

Tree report:  Arborist sent in her evaluation of the Town’s trees.  Estimates and permitting process for removal will start on those trees noted. The tree stump where the Brookeville Angel is sitting upon is rotting with evidence of carpenter ants.  Town Commissioners will try and decide what needs to become of the Angel.

SHA:  report has been signed and mailed.

MML Dinner:  Michael Acierno and Katherine Farquhar represented Brookeville at the MML Montgomery County Chapter Annual Dinner.  Both reported that attending the dinner afforded ample opportunity to network with state and local officials regarding the Bypass.

GOCA: a GOCA representative contacted Michael Acierno with questions regarding the status of the Brookeville Bypass.  GOCA has heard there is a lawsuit being filed against the Bypass with SHA.

November 10, 2008 Commissioners Meeting Minutes

November 10, 2008

Commissioner President Michael Acierno, Commissioner Robert Heritage, Commissioner Katherine Farquhar, Town Clerk Cate McDonald, Academy Manager Andrea Scanlon, Treasurer Susan Johnson was away. Present during all or portions of the meeting were Councilmember Nancy Floreen, Gazette Reporter Terri Hogan, and several Town Resident

Brookeville Bypass: Councilmember Floreen, Chair of the Transportation and Environment Committee for the Montgomery County Council, gave an update regarding the Brookeville Bypass. Her Committee will recommend $10M funding for the design and land acquisition need for the Bypass at next Tuesday’s public meeting of the full Council, funds to be used starting FY2011. If all approvals are met, construction of the Bypass could begin in 2015. County Councils goal is work with our State Delegation for funds.

Councilmember Floreen is proposing an Environmental Impact Study before funding the Brookeville Bypass. Commissioners plan on sending the County Council letters stating that the Brookeville Bypass has already been approved and is now waiting funding – no additional studies / surveys are needed and the Brookeville Bypass is the least expensive project on MDOT’s list that will benefit the County. Town Residents will be urged to send letters in support of the Brookeville Bypass.

Academy Update:

  • no new rentals to report
  • Heater is working fine and did not exceed the $8000 estimate
  • Commissioners approved interior painting of the Academy
  • Academy Manager working with suppliers to determine cost effectiveness of buying our own propane tank vs. leasing the tank from a supplier.

Holiday Party: Town’s Annual Holiday Party is Dec 6th from 6pm – 11pm. Town will provide a supervised children’s room, beverages, ham and a cake. All Town residents will be mailed an invitation.

Emergency Preparedness: seminar will be presented by the Auxiliary of MoCo Volunteer Fire and Rescue Association 7:30pm Nov 17th at the Brookeville Academy

Light Shield: request made to determine if a light shield can be attached to Town’s ornamental lights.

MML Fall Conference: Commissioner Farquhar represented the Town at the Friday, Oct 24th business session and dinner and gave a short review of her day.

Financial: The October financial report was reviewed.

309 & 311 Market: case is moving forward with Montgomery County with a court date of Nov 25

October 13, 2008

Minutes: The September 2008 Commissioners Meeting minutes were approved.

Academy Update: The new heater has been ordered with an expected delivery date of 20Oct; Brown’s Refrigeration will install shortly afterwards with an anticipated completion date of 15Nov. Approx. cost: $8000 for heater, installation, minor flue work. After the new heater is installed, the Commissioners will consider a tank less hot water heater, remote thermostat control system to help reduce heating / cooling costs, and rerouting of the upstairs flue.

Propane: our current propane tank is leased with Suburban Propane. Academy Manager is looking at cost associated with purchasing a tank and using a different supplier. Academy has not bought propane in 2 years, due to furnace failure, and Suburban propane prices are higher than their competitors and not willing to match a lower price.

Financial Report: The September financial report was reviewed.

Speaker: so far, no “green” speakers have been engaged. Treasurer will contact MCVFRA for an Emergency Preparedness presentation.

MML Fall Conference: Commissioner Farquhar will represent the Town at the Friday, Oct 24th business session and the dinner that will follow.

309 Market: still no progress and the case is moving forward with Montgomery County

Present during all or portions of the meeting were Gazette Reporter Terri Hogan, Fred Teal, and Craig Zucker

Comptroller of Maryland report: Deputy Chief of Staff Craig Zucker presented a Proclamation from the Comptroller recognizing the Town’s Bicentennial of Incorporation. Advised that Town will receive $ 9,756.40 State Highway use funds, approximately 2.4% less for FY 09-10 as State has less funds this fiscal year. Zucker reported that Brookeville Bypass is on the bottom of the Counties road priority list hence not on the States priority list. Suggested working with our State Delegation to get priority; suggested we invite Maryland Secretary of Transportaion to visit Brookeville to see why the Bypass is needed.

BEAC: Fred Teal gave the Commissioners minutes from all the BEAC meetings; Fred Teal is the only remaining member of BEAC. Commissioners advised they will look for ways to restructure the BEAC and gave their sincere gratitude to Fred Teal for all his hard work. Mr. Teal outlined the renewable energy options with cost comparisons and environmental impact for the Commissioners to review. Mr. Teal advised he will be available for consultations regarding Green Energy options.

Community Speaker: Town Clerk will engage a speaker to help educate residents on energy and environmental related issues for the month October.

Street Lights: Town Clerk will request Pepco to replace street lights with energy-saving, high-pressure sodium fixtures. Light sensors on existing fixtures will be repaired / replaced.

Minutes: The August 2008 Commissioners Meeting minutes were approved.

Financial Report: The August financial report was reviewed.

MML meeting: Commissioners Acierno and Farquhar represented Brookeville at the August MML Montgomery County Chapter meeting. Asst. Secretary of Maryland’s Dept. of Transportation was the featured guest and reported that the State is working on traffic light sync program. Commissioners discussed if Georgia Avenue is a designated evacuation route and the need for the Brookeville Bypass. Next MML Chapter meeting is Sept. 25 in Kensington.

Traffic Enforcement: Commissioners received a letter from Montgomery County Chief of Police Thomas Manger regarding traffic along High and Market Streets; advised speed enforcement cameras not an option on one lane roads but will work with SHA to improve pedestrian safety and increase speed enforcement.

Schoolhouse: Town will consult with Walter Blank regarding repairs to the one room schoolhouse.

2008 Community Night: Town will not participate in OCC Community Night on Oct. 2nd but will in 2009.

Academy Update: downstairs thermostat repaired resolving the AC issue; Trane AC unit has been evaluated and should last several more years. Academy Manager outlined bids from 2 contractors regarding the current heating system and proposed replacing the non working furnace with a similar model with a stainless steel heat exchanger that will be more energy efficient, providing heat this winter: cost approx. $7,000; flue may need to be replaced as it was partly to blame for current furnace malfunction: cost approx. $5,000. Academy Manager still working with bidding contractors to determine the most cost effective, energy efficient way to replace furnace.

New rental rates will go into effect September 15th.

Wireless router will be ordered and installed at the Academy

Market Street: repairs to Eastern Market Street were performed; speed bumps need to be repainted and possibly redone.

Arborist: Town Clerk working to engage the service of Arborist Phil Normandy

Fallen Tree: a tree fell recently from South Street onto the back lawn of the Academy. Fallen tree determined not to be impeding pedestrian or motor traffic and will remain in its natural resting spot.

August 19, 2008 Commissioners Meeting Minutes

August 19, 2008

Minutes: The July 2008 Commissioners Meeting minutes were approved.

Financial Report: The July financial report was reviewed

Bicentennial Celebration: plans were reviewed for the upcoming August 24 Incorporation Bicentennial. The Commissioners passed a resolution to allow musical entertainment on the lawn for this event only.

BEAC: the newly formed Brookeville Energy Advisory Committee has disbanded; all but 2 members have resigned. Commissioners will try to organize informal talks amongst interested residents concerning energy issues.

Academy Heating and Cooling: 2 quotes received: Both contractors say the system needs to be replaced estimated cost $6000-$7500. In addition, flue may need to be rerouted. Option to put in coils instead of heater to make more energy efficient, estimated cost $12,000 – $15,000; tank less water heater: est. $3500; control panels: est. $6500. Academy Manager still working on options and estimates bare minimum repairs at $7500 and up to $25,000 to overhaul the system. The AC system is also not working properly and repairs are being made.

MML Meeting: next meeting Aug. 28th in Town of Somerset. Commissioner Farquhar will represent Brookeville.

Clothes Collection Box: a Town Resident requested permission to have a Planet Aid Clothes Collection box in Town. The Commissioners decided against this request as there are several boxes in the local area and there is limited space in the Town.

Large Trash: the Town will have a trash dumpster placed in Town for residents to dispose of large, bulky items in October. Residents will be notified via mail and Brookeville Times.

309 & 311 Market St: owner was served an abatement notice. Owner did not show up at the County Judicial hearing. Still no final decision as to the status of the properties.

Academy Rental Rates: Academy Manager compared the Brookeville Academy current rental rates to other local venues. Academy is reasonably priced for its amenities and rates need to be raised as operating costs have increased. Commissioners approved a moderate rental rate increase for the general public and town residents. Jeff Issokson rates were modestly increased and the Commissioners approved his request to add Monday nights to his long term rental.

Handyman: Academy Manager requested permission to contract a handyman for various jobs around the Academy. Commissioners approved the request.

July 14, 2008

Brookeville Energy Advisory Committee (BEAC) presented their findings regarding the Academy’s HVAC.

Commissioner Acierno reports:

  • CELP requires 7 year payback; using CELP for geothermal system cannot be used since we cannot meet the 7 year payback requirement, would need to use commercial loan at higher interest rate
  • Town will receive less money from State for road maintenance
  • Economic times are not well and Town needs to conserve reserve fund
  • Not enough time to apply for loan and permits before start of winter, therefore Academy will be without heat

Town will request bids to replace / repair existing heating system with work completed before winter: estimated cost $5000

BEAC is working on the following:

  • Expenditure / environment benefits of purchasing wind power from Pepco. BEAC needs clarification from Pepco how the wind energy program is managed.
  • Determine anonymous, voluntary way to audit Town Resident energy use and offer tips on way to reduce / reuse / recycle
  • Find and report low tech ways to reduce energy consumption
  • Reduce light pollution by using lamp hoods; would be able to use lower wattage bulbs to reduce energy consumption
  • Consultant to perform energy audit

Financial Report: The June financial report was reviewed

FY 2008-2009 Budget: approved and signed

Audit: FY 2008 audit will cost $5500. Audit document not signed due to typo; Treasurer will request corrected copy

Meeting: Commissioners will meet with Councilman Mike Knapp and Del. Karen Montgomery July 31 at 7:00 p.m. to discuss funding of Market St repair and reducing traffic and speed in Town and various issues that effect the Town

HVAC: Town will repair current heating system; Academy Manager will request bids

Academy maintenance: will hold off any major maintenance (painting, floor finishing) until after HVAC cost is determined; ok to replace a worn table

Academy rentals: Commissioners approved updated rental contracts with minor corrections. Commissioners requested Academy Manager to draw up recommendations to improve facilities to increase rentals; Commissioners will wait to approve rental rate increases until they review recommendations. Jeff Issokson requested to add Monday from 3:00 p.m. – 8:00 p.m. in addition to his 3 day a week long term rentals. Commissioners will wait to make a decision on this request until new rates are determined.

Donation: Commissioners approved $250 monetary donation to National Night Out sponsored by Olney Chamber of Commerce, the Montgomery County Police, the Sandy Spring Volunteer Fire Department, the MD-National Capital Park Police and the Longwood Recreation Center.

Market Street: Clerk requested quote from County contractor Slurry Pavers; Clerk will request additional quotes for pothole repairs

Trash: Waste Management advised they are raising rates

Aug 24: American Legion ceremony will be at 12noon. Town will celebrate occasion with picnic and local entertainment at Academy and Schoolhouse.

June 9, 2008 Annual Commissioners Meeting Minutes

June 9, 2008

Resident Meeting with Councilman Michael Knapp (D-Dist. 2) started 7:00 p.m. Councilman Knapp fielded question from Town Residents:

  • Brookeville Bypass: 3rd or 4th on the Counties priority list; County Council is looking at alternate forms for transportation funding such as bonds, public / private partnerships. Several residents expressed their frustrations about the long delay in funding the Bypass and safety concerns due to traffic.
  • Councilman Knapp will work to standardize HPC permitting for historic buildings wanting to use energy efficient technology
  • East Market Street: Town requests county funding for repairs of Market Street. Councilman Knapp will set up a time to meet with the Commissioners to discuss the possibility of county reimbursement for Market Street repairs
  • Deterioration of Brookeville Road intersection with Market Street needs to be addressed by the County
  • Councilman Knapp will look into speed camera for Northbound Georgia Avenue in an effort to slow traffic through Town. Also consider restricting truck traffic through Brookeville.

Councilman Knapp departs at 7:50 p.m.

  • Trees: several large trees fell in Brookeville during the June storm. The Town will look into hiring an Arborist to consult about the health of our trees and how to reduce risk to property in future storms.

Commissioners meet for June’s Commissioners Meeting following the Town Meeting

Election: Commissioner Acierno was nominated by Commissioner Farquhar to be President of the Commissioners; unanimously approved

Minutes: May’s Commissioners Minutes were approved

Annual Town Meeting Minutes were approved

Financial Report: The May financial report was reviewed.

Powers Wood: The Commissioners will contact Rick Allan regarding the Powers Wood land use charter

Accutech: the plus / minus of Accutech Security was discussed. Recent interactions with Accutech during the June power outage were not positive. Academy Manage Scanlon will conduct a walkthrough of the security system with the Commissioners on Saturday.

Brookeville Energy Advisory Committee: The final draft of the Charter was submitted by Fred Teal. The draft was approved with minor changes. Fred Teal, Doug Palmer, Debora Wagner, Harry Montgomery, and Andrea Barr were appointed by the Commissioners to serve for a 2-year renewable staggered terms.

Correspondences: Commissioner Acierno will draft the following letters

  1. Thank You and follow up with Councilman Knapp
  2. 309 Market Street and 311 Market Street code enforcement prior to hearing date

HVAC: Heat pump with propane backup being considered; the cost of erosion control and landscaping needs to be factored into test boring cost for geothermal system

Academy Rentals: Academy Manager Scanlon reports that Academy rentals are increasing; she is working on updating the rental contracts and will presents drafts of proposed changes at the next Commissioners meeting.

Gutters: Commissioners were presented with 2 options for cleaning the Academy’s gutters

  1. One time cleaning quoted at $120
  2. Yearly contact for 3 cleaning quoted at $300

The Commissioners approved the $300 yearly contact quote from Royal Gutters

May 21, 2008 Annual Town Meeting Minutes

May 21, 2008

  • Town directory is ready for distribution; one copy per town household. Resident present signed for their copy; remaining copies will be available from the town clerk.
  • SUMC will be hosting a farewell luncheon for The Geib Family; all town residents are welcome June 15th 11:30am
  • Introduction of new Town Clerk Cate McDonald and Academy Manager Andrea Scanlon
  • Election results announced: Michael Acierno elected to another 2 year term
  • Draft of FY08-09 budget reviewed
  • Geothermal update: Town still reviewing Geothermal option; majority of town residents in favor of Geothermal vs. propane; Commissioner Acierno presented various options of financing including CELP, increased state grant money starting July 08
  • Citizen Energy Committee announced via a brief presentation from Fred Teal. Interested residents should contact Fred Teale; the current membership (Fred Teal, Debbie Wagner, Harry Montgomery, and Andrea Barr) is working on their charter to be submitted to the Commissioners for review. There was suggestion from residents that they publish green tips in the Brookeville Times.
  • Question posed to town residents: how Green does Brookeville want to become? Do the citizens feel that the Town should become a model of energy efficiency, environmental friendliness? Encourage residents to share their thoughts with the Commissioners.
  • ByPass update: need to be a higher priority with county to receive funding
  • Suggestion to invite County Exec Ike Leggett and County Council President Mike Knapp to a future town meeting related to the Bypass/Environment-Energy focus/Historical commemoration so they can personally hear the concerns of town residents and understand the issues.
  • 309 Market St: owner of 309 & 311 Market St being taken to court June 17 for county code violations; process moving slowly through the county system. Town Commissioners will send a letter to the Judge supporting enforcement of county code
  • Market St update: Town trying to get state / county funding for Market St but so far have received no support; Town’s stance is Market St is no longer a road for residence but it is a major thoroughfare for commuters lining in the developments around Brookeville. Will have county contractor to bid on pot hole repair; asphalt patch by town not a durable alternative.
  • Master Plan: Planning Commission will review the draft Master Plan at their July Meeting. Master Plan will be made available to town residents for review prior to a community meeting. Interested residents should contact Town Clerk for a copy.
  • August 24 Incorporation Celebration announced by Commissioner Farquhar; residents should contact Commissioner Farquhar if they are interested helping to plan this event; discussed pre-planning for 2014 celebration of the Madison party’s stay in Brookeville (Capital for a Day).

Citizen Energy Committee: Formally authorized by Commissioners vote; will review Mission Statement of new committee before the town meeting May 21

Town Budget: reviewed FY 2008-2009; will present at May 21 town meeting

Comprehensive Plan: submitted to Planning Commission for review

Town Election: The Town Election will by May 13th from 4:00 p.m. to 9:00 p.m.

Town Directory: Andrea Scanlon presented draft of Town Directory. Will have draft copy available for residents to review at Academy after they vote.

Market Street Repairs: The Commissioners asked the Clerk to contact Montgomery County to receive the rate charged to the county for road repairs.

August 24 Committee: Formally authorized by Commissoner vote; buildup to 200th anniversary War of 1812

Heritage Grant: report due sometime in June; Clerk McDonald will start working on the report.

Greenskeepers: need to contact about trail maintenance; with recent rain, may need to have trails serviced 3 times this year vs. 2 times.

Minutes:   The March 2008 Commissioners Meeting minutes were approved with one minor correction.

Financial Report:  The March financial report was reviewed.

Review Geothermal bids – Set date for geothermal town meeting: The Commissioners discussed the various geothermal heating system bids received.  They decided to hold a town meeting on April 29th to invite comments on the various alternative heating systems for the Academy.

Greenskeeper fuel surcharge – 3%:   Our landscaping contractor, Greenskeeper, informed us that they had to add a 3% surcharge to their bid to cover rising fuel costs.  The Commissioners agreed with that necessity.

Permits:  The Commissioners discussed two permits forwarded by the Planning Commission. They actions taken were:

  • Chad Wheeler and Michael Yesenko permit ready for signature. They signed it and requested the clerk give to Margaret to send copy of signed permit to Chad and Michael.
  • 1 South Street permit – wait to sign until receipt of HAWP

Low hanging wires at Madison House: The Commissioners discussed this issue.  The Planning Commission will ask Doug Lomeyer Consulting to write a letter to Pepco regarding the situation.

MD Citizens Planner Association:  The Commissioners voted to remain a member of this organization and asked the treasurer to send our dues.

Comprehensive Plan – Rick Allan:  The Comprehensive Plan has been typed into Word.  The Commissioners voted to use Rick Allan for a fee of $300 to review for compliance with State standards.  They established a deadline for completion and submission to the Town by the May 21st Town Meeting.

Budget for next fiscal year:  The 2008-2009 budget is being developed and will be presented to the residents at the May 21st Town Meeting. 

Town Election:  The Town Election will by May 13th from 4:00 p.m. to 9:00 p.m.

Status of Town Clerk and Academy Manager search:  A new Town Clerk and a new Academy Manager have been selected.  The Commissioner decided to hire Kate McDonald as the Clerk and Andrea Scanlon as the Academy Manager.  The Commissioners decided to have them begin work on May 1st.  They will ask the Clerk to set structured hours for being in the office.

Farewell party for Paul:  The Clerk suggested that Commissioner Acierno contact Mary Ellen Brown at SUMC to possibly coordinate with the church on a farewell party.

August Celebration: Commissioner Farquhar hosted a meeting of residents on April 22nd to work on planning the 200th anniversary celebration.

Town Directory:  Andrea Scanlon is working on finishing the Town Directory.

Market Street Repairs:  The Commissioners asked the Clerk to contact Montgomery County to receive the rate charged to the county for road repairs.   

Street Lights:  Clerk Geib asked for permission to contact Lighting Maintenance to perform work on the ornamental light at 308 Market Street.  It needs a new base.  He will inventory the other ornamental lights that stay on during daylight to have Kirby Electric see if they can adjust the sensors.
